Please read these Terms of Service before using Popsicle's platform and services.
1. Acceptance of Terms
By accessing or using Popsicle's platform and services, you agree to be bound by these Terms of Service. If you do not agree, you may not use our services.
2. Description of Service
Popsicle provides a cloud-based school program management platform that helps private schools manage after-school programs, camps, enrichment classes, registration, rosters, payments, and parent communication.
3. User Accounts
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Please notify us immediately of any unauthorized access at support@getpopsicle.com.
4. Payment Terms
Subscription fees are billed monthly at the agreed-upon rate. Transaction fees apply to payments processed through Popsicle. Fees are non-refundable except where required by law. We will give 30 days' notice of pricing changes.
5. School and Student Data
Schools retain ownership of all data they input into the platform, including student and family information. Popsicle processes this data only to provide the service and complies with applicable education privacy laws including FERPA and COPPA.
6. Acceptable Use
You agree to use Popsicle only for lawful purposes related to school program management. You may not attempt unauthorized access, interfere with platform operations, or use the service to transmit harmful content.
7. Intellectual Property
The Popsicle platform, brand, and content are owned by Popsicle Inc. and protected by applicable intellectual property law. You may not reproduce or distribute the platform without written permission.
8. Limitation of Liability
To the extent permitted by law, Popsicle is not liable for indirect, incidental, or consequential damages. Our total liability in any matter will not exceed the fees you paid in the 12 months preceding the claim.
9. Termination
Either party may terminate this agreement at any time. We will give you a reasonable period to export your data before deletion. Popsicle may suspend accounts that violate these terms.
10. Governing Law
These terms are governed by the laws of the State of Delaware, without regard to conflict of law provisions.
